E-Giftcard regulation – The Essential Clinic
Terms and Conditions
THE ESSENTIAL CLINIC E-GIFT CARD TERMS AND CONDITIONS
UPDATED FEBRUARY 2023
1. The E-GIFT CARD can be purchased at the online store www.theessentialclinic.com. It is a non-personal card issued and activated on the web, and can be used for future purchases or as a gift for family or friends. All items purchased with a gift card are not eligible for a cash refund.
2. The E-GIFT CARD will be sent by email to the recipient indicated by the buyer at the time of purchase, and can be used immediately to purchase products in the online store www.theessentialclinic.com or in the physical facilities of The Essential Clinic located at Rambla Catalunya 16, 2-2, Barcelona – Spain, in accordance with the rules listed below.
3. DURATION: The E-GIFT CARD has an expiration date of 6 months to be used from the moment of purchase.
4. The initial balance of the E-GIFT CARD will be variable at the consumer’s discretion, from a minimum of €100.00 to a maximum of €2,000. The existing balance in the E-GIFT CARD will not be refunded or exchanged for money.
5. The E-GIFT CARD is strictly for private use and for purposes other than commercial, business, trade or professional activity.
6. It has no activation costs and cannot be recharged.
7. It is activated online, by paying the corresponding amount using one of the payment methods accepted on the website: (Credit/debit card).
8. At the time of purchase, the customer will be sent a confirmation of the purchase by e-mail, indicating the amount charged to the E-GIFT CARD and with the conditions of use of the card that have been previously informed and accepted.
9. The E-GIFT CARD may be used (in whole or in part, on one or more occasions until the available balance of the E-GIFT CARD is used up):
– On-line, on the website www.theessentialclinic.com.
– In the physical facilities of The Essential Clinic located at Rambla Catalunya 16,
2-2, Barcelona – Spain.
10. For each purchase, the corresponding amount will be deducted from the remaining credit associated with the E-GIFT CARD. The available balance on the E-GIFT CARD is the difference between the available balance immediately prior to making a purchase and the amount used to pay for that purchase. If the amount of the purchase is greater than the available balance on the E-GIFT CARD, the difference can be paid through any form of payment accepted at The Essential Clinic’s Physical Clinic or online at https://theessentialclinic.com/.
11. The holder of the E-GIFT CARD may check the balance and transactions of the card at any time. If the balance of the card is not depleted, the customer will not be entitled to any refund of any kind. The balance of the E-Gift Card is not convertible into cash.
12. The E-GIFT CARD cannot be used to purchase other E-GIFT CARDs. The amount associated with the E-GIFT CARD does not accrue interest and may not be transferred to another E-GIFT CARD of any kind.
13. The E-GIFT CARD will not be accepted if it has not been activated or if it has been altered, tampered with or contains more indications than the pre-printed indications. Handwritten additions will not be accepted.
14. The E-GIFT CARD is a means of payment to the bearer. If it is misused, lost or stolen, it cannot be replaced or returned. We recommend that you keep it as if it were cash. The issuer declines all responsibility for the improper or fraudulent use of gift cards.
15. By purchasing and using the E-GIFT CARD, the consumer accepts these conditions, which appear on the website https://theessentialclinic.com/
16. This company reserves the right to modify these terms and conditions of use of the E-GIFT CARD without retroactive effect for consumers who have purchased the E-GIFT CARD prior to such modification. The applicable E-GIFT CARD terms and conditions of use shall be those in effect and provided in the pre-contractual information at the time of purchase of the E-GIFT CARD. The commercial purchase shall be deemed to occur on the date of receipt of the E-GIFT CARD e-mail.
17. The issuer reserves the right to verify the correct use of the E-GIFT CARD, and in the case of violation of the regulations, may request its immediate return. The rights to the services related to the E-GIFT CARD will be immediately suspended in case of misuse of the E-GIFT CARD by the holder.
18. The consumer or user may exercise the right of withdrawal from the purchase of the E-GIFT CARD within 14 calendar days after the purchase of a gift card without stating the reason. The computation of the above period shall begin on the day of receipt of the card in the email indicated by the consumer or user.
To determine the observance of the withdraw period, the date of issuance of the declaration of withdrawal shall be taken into account. The right of the withdrawal can be exercised by sending the unequivocal declaration of withdrawal by means of the return form (see return form) link claim form or conditions. The exercise of the right of withdrawal will not involve any cost for the consumer and user. As a consequence of the right of withdrawal, the parties shall return to each other the services provided. The consumer will be refunded the sums paid without retention of costs within a maximum period of 14 calendar days from the date on which it has been informed of the decision to withdraw from the contract by the consumer and user.
Please note that The Essential Clinic is not obliged to return the amount of your refund in cash, the refund will be made by the payment method accepted on the website or at The Essential Clinic physical facilities (Credit / debit card).
19. The exercise of the right of withdrawal for compliant products purchased through E-GIFT CARD at www.theessentialclinic.com will mean that the amount of the purchase will be refunded through a credit or return card that can be used by the consumer to pay future purchases at The Essential Clinic physical or online facilities.
20. Processing of personal data: The purchase of the E-GIFT CARD involves the communication of the personal information of the person making the purchase, which will be processed by the owner of the company in accordance with current legislation on the protection of personal data, as specified in the information provided in the “Privacy” section.
21. Notifications and/or complaints about the use of the E-GIFT CARD can be sent by e-mail to info@theessentialcilnic.com.
22. Any dispute arising from the use of the E-GIFT CARD shall be governed by applicable state legislation.
